Establishing protocols for global extradition disputes in politically nuanced cases requires a delicate calibration between sovereign enforcement and human rights protection. The central challenge lies in modernizing the traditional "political offense exception" which is a legal doctrine that allows states to refuse extradition for acts deemed political in nature, such as sedition or espionage without creating loopholes for genuine criminals to evade justice. Effective protocols must therefore move beyond binary treaties and incorporate robust judicial review mechanisms that assess not just the legality of the request, but the intent behind it. This includes standardizing diplomatic assurances, guarantees of fair treatment and strictly enforcing non-refoulement principles to ensure that international law enforcement tools, such as Interpol Red Notices, are not weaponized to target dissidents or political rivals.
